1. Acceptance of Terms

By purchasing one or more digital services from The Digital Agency, you (“the Client”) agree to be bound by these Terms and Conditions. Please read these Terms and Conditions carefully, as they govern the relationship between the Client and The Digital Agency (“the Provider”).

2. Services

The Provider shall provide the Client with the purchased services as outlined in the chosen selections of the service components.

3. Payment

The Client shall pay the Provider the calculated fees (using various online payment methods) as shown at the last step for the services’ checkout page. The calculated amount at the last step represents the final price of the requested products/services based on the selected components of the desired digital services, products, or solutions.

4. Intellectual Property Rights

Upon online payment successfully, the Client shall own all intellectual property rights to the digital services and the planned content as selected in the steps form, excluding any third-party materials, such as stock images or fonts, that may require additional licensing. The Provider retains the right to showcase the products/services in their portfolio as long as it doesn’t reveal any confidential data.

5. Client Responsibilities

The Client is responsible for providing all necessary information, content, product descriptions, and materials required for the completion of the project. Failure to do so at the time of purchase may result in project delays or additional fees.

6. Warranty & Support

The Provider warrants that the products/services will be functional and free of any significant defects. Any minor defects discovered within 30 days of project completion will be rectified by the Provider at no additional cost to the Client. This warranty does not cover issues arising from the Client’s negligence, misuse, or third-party modifications.

7. Limitation of Liability

The Provider’s liability for any claim arising from the provision of services shall be limited to the amount paid by the Client for the services.

8. Cancellation & Refund Policy

The Client may request a full refund within 48 hours of project commencement. After this period, no refunds will be issued.

8.1 Conditions for Cancellation Eligibility:

  • The services were purchased within the last 48 hours
  • The services have not yet started delivering performance results (e.g., launched pages on your website, traffic to your website or social engagements/followers, ads, web/graphic designs, .. etc)
  • The following goods cannot be cancelled or refunded:
    • The supply of products/services made on your owned media, such as website, social media pages, etc.
    • The supply of products/services which according to their nature are not suitable to be cancelled.
    • The supply of products/services which are, after delivery, according to their nature, inseparably mixed with other items that cannot be cancelled.

We will reimburse you no later than 14 working days from the day on which we receive the eligible cancelled services. We will use the same means of payment as you used for the order, and you will not incur any fees for such reimbursement.

We reserve the right to refuse cancellations of any merchandise, products, or services that do not meet the above cancellation conditions in our sole discretion.

9. Termination

Either party may terminate this agreement by providing written notice if the other party breaches any material term or condition. The breaching party has 7 days to remedy the breach; if not remedied, the agreement may be terminated. Upon termination, the Client must pay for all work completed up to the termination date.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Dubai Government. Any disputes arising from this agreement shall be resolved exclusively in the courts of Dubai Courts.

11. Amendments

The Provider reserves the right to modify or update these Terms and Conditions at any time. The Client’s continued use of the Provider’s services after any such changes shall constitute acceptance of the Terms and Conditions acknowledged at the time of purchase.

By purchasing any digital products/services/solutions from the Provider, the Client agrees to be bound by these Terms and Conditions.
